Terms of Service

These Terms of Service ("Terms") govern your use of the website operated by Joistic Technologies ("we", "our", or "us") at https://www.joistic.com, our development services, and our mobile applications and games, including Cap No Cap (together, the "Services"). By accessing or using any of our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Use of our website and services

  • You must be at least 13 years old to use our Services.
  • You agree to use the Services only for lawful purposes and in a way that does not infringe the rights of, or restrict the use of the Services by, anyone else.
  • You may not attempt to gain unauthorised access to any part of the Services, probe or scan for vulnerabilities, or interfere with their normal operation.

Mobile apps and games

We publish mobile applications and games, including Cap No Cap, available on the Apple App Store and Google Play. When you download one of our apps, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the app for your personal, non-commercial use on devices you own or control. You may not copy, modify, reverse-engineer, distribute, or resell the app or any part of it.

Your use of an app downloaded from the Apple App Store or Google Play is also subject to the applicable store's terms of service. If those terms conflict with these Terms, the store's terms prevail to the extent of the conflict for matters the store governs (such as billing and refunds).

Advertising

Our apps and games are free to download and are supported by advertising. By using our apps, you acknowledge that third-party advertisements (served through networks such as Google AdMob) may be displayed during gameplay. We do not control the content of third-party advertisements and are not responsible for the products or services they promote. Information about the data advertising partners may collect is described in our Privacy Policy.

In-app purchases

  • One-time purchases. Our apps may offer optional one-time in-app purchases — for example, to remove advertisements or unlock additional content. These are one-time, non-recurring purchases; we do not currently offer subscriptions.
  • Billing. All in-app purchases are processed by the Apple App Store or Google Play. We never receive or store your payment card details. Prices are shown in your local currency before you confirm a purchase and may vary by region.
  • Refunds. Because purchases are processed by the app stores, refunds are governed by the refund policies of Apple and Google. Refund requests must be made directly through the respective store. Except where required by law, all purchases are final and non-refundable.
  • Restoring purchases. One-time purchases are tied to your App Store or Google Play account. If you reinstall the app or switch to a new device signed in to the same store account, you can restore your purchase from within the app at no extra cost.
  • No transfer. Purchases are non-transferable between accounts or platforms (for example, between an Apple ID and a Google account), have no monetary value outside the app, and cannot be exchanged for cash.

User conduct in our games

Some of our games allow players to enter custom words, categories, or other content during play. You are responsible for anything you enter, and you agree not to submit content that is unlawful, hateful, or infringes anyone else's rights. We may suspend or terminate access to our apps for users who violate these Terms.

Intellectual property

All content on our website and in our apps — including text, graphics, logos, game mechanics, card decks, software, and design — is owned by Joistic Technologies or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without our prior written consent.

Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the maximum extent permitted by law, Joistic Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Services. Our total liability for any claim arising from the Services shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.

Changes to the services and these terms

We may modify, suspend, or discontinue any part of the Services — including features, content, or availability of our apps — at any time. We may also update these Terms from time to time; when we do, we will revise the "last updated" date at the top of this page. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.
